Marriage between a Hindu (boy/girl) and a Muslim (girl/boy) is governed under the Hindu law, Muslim Law and the Special Marriage Act, 1954. The Personal laws have bearing on issues relating to maintenance, divorce, succession, adoption etc.

The Special Marriage Act, 1954 provides for a special form of marriage in certain cases such as between people of different faith and for the registration of such and other marriages and also for divorce available to all citizens of India married under the Act.

A Hindu (boy/girl) and a Muslim (girl/boy) could get married under this Act and can also have a wedding performed according to their own religious rites, for their own satisfaction and no conversions are required.

Under Special Marriage Act, 1954

A marriage between any two persons may be solemnized under this act, if at the time of the marriage the following conditions are fulfilled, namely:–

  • Neither party has a spouse living
  • The parties should not be of unsoundness of mind of such a nature as to be unable to give valid consent for the marriage, or suffering from mental disorder of such a kind or to such an extent as to be unfit for marriage and procreation of children, or has been subject to recurrent attacks of insanity.
  • The male has completed the age of 21 years and female the age of eighteen years.
  • The parties are not within the degrees of prohibited relationship.
  • Provided that where a custom governing at least one of the parties permits of a marriage between them, such marriage may be solemnized, notwithstanding that they are within the degree of prohibited relationship.
  • Where the marriage is solemnized in the State of Jammu and Kashmir, both parties are citizen of India domiciled in the territories to which this Act extends.

Inter-Religion Marriage Registration Procedure and Precautions in India

Inter-religion marriage is registered under the Special Marriage Act,1954. This act is used when the one partner is from a non-Hindu religion.

The special marriage Act, 1954 supports Inter-Religious Marriage Registration for those who want to get married outside their religions with legal support and backing. The couple has to give a notice to the marriage officer of the local district in which one of the partners is living for at least 30 days preceding the date of the notice. The notice is kept for 30 days, and if there is no objection from any quarter, the marriage is solemnized. The couple must meet the legal age requirements of the marriage. The bride must have crossed the age of 19 and the groom must be above 21 years of age at the time of the marriage.

The couple must also come with the documents and certificates to show back the age claim. Court Marriage Registration Requirements And Precautions

Court Marriage Registration is done for the couples who want to tie the knot in a court in presence of legal experts. The couple decides to go after court marriage when they fear that the normal way is a bit complicated for them or their families may not be in favor of their marriage. The court marriage gives legal acceptance to partners to live as Husband and Wife in the society.

Court marriages are solemnized under the Special Marriage Act, 1954. Court marriage can be performed between an Indian male and a female irrespective of their caste, religion or creed. It can also be solemnized between an Indian and a foreigner. The procedure of the Court marriage does away with the rituals and ceremonies of the traditional marriages. The parties can directly apply to the Marriage Registrar for performance & registration of marriage and grant of the marriage certificate.

First of all, the couple applies for the Court Marriage Registration must make sure that they are of the right age for the marriage. There are some documents that each partner must bring for court marriage registration. The first is Date of Birth Certificate of each partner, Passport Size Photos, Residential Proof ( VoterID Card / Passport / Driving licence / Ration Card ), Proof of Divorce(if any of the partners is a divorcee), Widow or Widower, in case of a previous marriage of either partner and/or No Objection Certificate from concerned embassy of the country of the partner who is foreigner, has foreign Passport or resides in the foreign country. The presence of witnesses is also very important at the time of the marriage. The witnesses must bring with them the Residential Proof and Passport Size Photos.

Essential Conditions For Court Marriage
  • There should not be subsisting valid marriage of either of the parties with any other person.
  • The bridegroom should be of twenty-one (21) years and the bride should be of eighteen (18) years of age.
  • The parties should not be of unsoundness of mind of such a nature as to be unable to give valid consent for the marriage, or suffering from mental disorder of such a kind or to such an extent as to be unfit for marriage and procreation of children, or has been subject to recurrent attacks of insanity.
  • The parties should not fall within the degree of prohibited relationship.
Procedure Of Marriage When Both Parties Are Hindus
  • The parties have to file a Notice of Intended Marriage in the specified form to the Marriage Registrar of the district in which at least one of the parties to the marriage has resided for a period of not less than 30 days immediately preceding the date on which such notice is given.
  • The notice is then published/put-up by the Registrar of Marriage inviting objections, if any.
  • After the expiration of 30 days from the date on which notice of intended marriage has been published, the marriage may be solemnized unless it has been objected by any person.
  • The marriage may be solemnized at the specified Marriage Office.
  • Both parties along with three witnesses are required to be present on the date of registration/Solemnization.

Court Marriage of an Indian and a Foreign National

A marriage between parties one of whom at least is a citizen of India may be solemnized under Special Marriage Act, in India before a Marriage Registrar in India or a Marriage Officer in a foreign country.

Eligibility Criteria

At least one of the parties should be an Indian citizen.

The bride groom must be 21 years of age; the bride must be 18 years of age.

Neither party has a spouse living.

Neither party is an idiot or a lunatic.

The parties are not within the degrees of prohibited relationship.

Each party involved should not have any other subsisting valid marriage.

Documents Required
  • Application form duly signed by both the parties.
  • Documentary evidence of the date of birth of parties.
  • Copy of Passport of both the parties with valid Visa.
  • Residential Proof of both the parties.
  • Documentary evidence regarding stay at district in India of one of the parties for more than 30 days (Proof of stay or report from the concerned SHO).
  • N.O.C. or Marital Status certificate from the concerned embassy or Consulate in India by a foreigner partner.
  • Death certificate or divorce decree whichever is applicable, in case one of the parties had any marriages in the past.
Procedure

The parties to the marriage shall give notice in writing in the form specified, to the Marriage Officer of the district in which at least one of the parties to the marriage has resided for a period of not less than 30 days immediately preceding the date on which such notice is given, and the notice shall state that the party has so resided.

All the documents are verified at the Office of Marriage Registrar.

The law of other nation shall not be in conflict with Indian laws.

The notice is then published inviting objection to the marriage, if any.

If no objection is made, then, on the expiry of the notice publishing period, the marriage may be solemnized.

Further, the Marriage Certificate is entered and is granted by the Marriage Registrar.

Christian Marriage Procedure in India

Parties who do not wish to marry in a religious ceremony can instead opt for a civil ceremony like Christian Marriage pursuant to the Indian Special Marriage Act of 1954.

In case a marriage between an Indian and a foreign national is to take place in India, generally, its required to file a notice of intended marriage with a Marriage Registrar of your choice in India. That notice is required to be published for the stipulated 30 days. At the end of the 30 days, the Marriage Registrar is free to perform the marriage.

The notice of intended marriage can only be given in India if at least one partner is permanently and the other partner temporarily resident in India.

If one partner is residing in a foreign country then the partner who is resident in India will have to fill out the Marriage Notice collected from the Marriage Registration Office of his/her choice in India and send it to his/her partner in the foreign country who will also have to fill it out. This Notice should then be sent back to the partner in India who will have to re-submit it at the Marriage Registration Office. After the stipulated waiting period of 30 days, the marriage can take place in India. Under the Special Marriage Act, 1954 a certificate showing the signatures of the persons married, the registrar and the witnesses will be issued. This Certificate is required as proof of the marriage and when applying for a visa to for a foreign country.

Documents are required for Marriages which have already been solemnized
  • Application form duly signed by both husband and wife.
  • Documentary evidence of the date of birth of parties (Matriculation Certificate / Passport / Birth Certificate). Minimum age of both parties is 21 years for male and 18 years for female, at the time of registration under the Special Marriage Act / Hindu Marriage Act.
  • Ration card of husband or wife, at least one should be resident of Delhi for 30 days.
  • In case of Special Marriage Act, documentary evidence regarding stay in Delhi of the parties for more than 30 days (ration card or report from the concerned SHO, Police Station).
  • Affidavit by both the parties stating place and date of marriage, date of birth, marital status at the time of marriage and nationality.
  • Two passport size photographs of both the parties and one marriage photograph.
  • Marriage invitation card.
  • If marriage was solemnized in a religious place, a certificate from the priest is required who solemnized the marriage.
  • Affirmation that the parties are not related to each other within the prohibited degree of relationship as per the Special Marriage Act. For details of such relationships please read below at end.
  • Attested copy of divorce decree/order in case of a divorcee and death certificate of spouse in case of widow/widower.
  • In case one of the parties belong to other than Hindu, Buddhist, Jain and Sikh religions, a conversion certificate from the priest who solemnized the marriage (in case of Hindu Marriage Act).
The Following Documents Are Required For Both The Partners
  • A valid Passport.
  • Original Birth Certificate showing parents’ names.
  • If the person concerned is widowed, the original death certificate of the deceased spouse.
  • If divorced, a copy of the final decree.
  • Documentary evidence regarding stay in India of the parties for more than 30 days (ration card or report from the concerned SHO).
